Omnia Insurance Group User Agreement – as of 2024

Welcome to the Omnia Insurance Group (“Omnia Insurance Group”) User Agreement.

This User Agreement (the “Agreement”) is a legal agreement between you and Omnia

Insurance Group and it governs your use of the Omnia Insurance Group website and service

(the “Service”). By using the Service, you consent to terms of this Agreement and to the terms of

the Omnia Insurance Group Privacy Policy posted on our website. If you do not consent to all

the terms of this Agreement and Privacy Policy, you are without authorization to use the Service.

Accessing the Service

The Service is made available to you only for your private use, or if you are signing up on behalf

of your company, for the use of your company. You and your company are solely responsible for

any activity that occurs under your user name, including, without limitation, all SPAM and other

legal compliance.

Communications

When you visit OmniaInsuranceGroup.com or send e-mails to us, you are communicating with

us electronically. You consent to receive communications from us electronically. We will

communicate with you by e-mail, through your Omnia Insurance Group Podio workspaces, or by

posting notices on this site. You agree that all agreements, notices, disclosures and other

communications that we provide to you electronically satisfy any legal requirement that such

communications be in writing.

Phone (Voice & Text Messages)

You consent to receive text message(s) when filling webforms, reaching out to support, placing

an order, scheduling a call, etc. You agree that all agreements, notices, disclosures and other

communications that we provide to you electronically satisfy any legal requirement that such

communications be in writing.

Omnia Insurance Group Communication Terms

By agreeing to our terms of service, you consent to receive communications via postal mail,

email, phone calls, and automated prerecorded voice messages from Omnia Insurance Group,

including its business divisions, affiliates, partners, vendors, list managers, and clients who

purchase our lists. You also agree to receive recurring communications for as long as you

remain enrolled in our SMS/MMS mobile messaging program.

We may share or sell the personal information you provide to third-party businesses to offer

selected retail opportunities through direct mail, email, SMS/text messages, and telemarketing

(including pre-recorded calls).

Your Consent

By submitting any form on our website, you acknowledge and agree that Omnia Insurance

Group and its representatives, agents, and partners may contact you via:

Legal Agreement

Agree that neither party shall be liable for indirect, incidental, or consequential damages (e.g.,

loss of profits).

You are solely responsible for any third-party fees incurred from communications sent by Omnia

Insurance Group or its partners.

By submitting a form, you forfeit the right to litigate based on prior alleged violations (e.g.,

unsolicited SMS, emails, or robocalls).

Severability

If any term is deemed unenforceable, the remaining terms remain valid.

Omnia Insurance Group User Agreement – Additional Terms

You also agree to be contacted on a recurring basis for as long as you are a part of our

SMS/MMS mobile message marketing program.

We may sell the personal information that you supply to us and may work with third-party

businesses to bring selected retail opportunities to our members via direct mail, email, SMS,

text, and telemarketing (including but not limited to pre-recorded phone messages).

You understand and agree that this consent applies even if your number is listed on a state or

By filling out any of our forms, you also agree that you cannot “build a case” against Omnia

Insurance Group (by counting infractions per solicitation) because submitting any forms or filling

out any information signifies that you are requesting to be contacted by email, SMS, text, and

pre-recorded phone calls.

In no event shall either party be liable for special, indirect, incidental, or consequential damages,

including, but not limited to, loss of use, or loss of profits.

Prospect’s Responsibility

The prospect agrees that he/she is solely responsible for any and all third-party fees incurred

when being contacted by Omnia Insurance Group and its business divisions, affiliates, partners,

clients, vendors, and list managers.

By filling out ANY of our forms, you also forfeit your right to litigate against Omnia Insurance

Group based on any previously alleged infraction (alleged infractions prior to you submitting any

forms) including, but not limited to:

Email

Robo-dialing

If any of the terms in this agreement are held unenforceable, the remaining terms shall remain

in effect.

Please DO NOT digitally sign this agreement by submitting any forms on any of our websites if

you do not agree with our terms and conditions.
